DISMISSAL OF PRODUCT LIABILITY ACTION IN ARKANSAS COURT

In an action filed in Arkansas state court, White & Wiggins attorneys won another victory for a medical device manufacturer alleged to have manufactured a defective product.

The plaintiff contended that the medical device, inserted during surgery, had a manufacturing defect that existed when the product left the manufacturing facility. In support of this position, the treating physician had claimed in a letter to plaintiff's attorney that the medical device had a defect. Not persuaded by the treating physician's letter to counsel, White & Wiggins' lead counsel deposed the treating physician who admitted there was no problem with the medical device when received from the manufacturer. Instead, the damage to the product occurred during surgery.

Plaintiff dismissed the lawsuit after the deposition and admission of the treating physician.
