Summary Judgment Granted in Premises Action.

In a personal injury lawsuit alleging six theories of liability against its hospitality client, White & Wiggins successfully defeated all causes of action brought by the plaintiff and won a summary judgment in Dallas County district court.  The White & Wiggins team, led by partner Deborah E. Lewis, argued throughout the lawsuit that its client owed no duty to the plaintiff because the client did not own, operate or manage the property at issue, and that there was no evidence of apparent agency or fraud and the plaintiff was not entitled to bring DTPA actions.  At the time of the summary judgment hearing, the only remaining theories were negligence theories.  The court sustained the objections to the plaintiff's summary judgment evidence and granted summary judgment in favor of the hospitality client.
